These Terms of Use ("Terms") govern your access to and use of the Cognivate application and website at cognivate.co (collectively, the "Service"), provided by Cognivate ("we", "our", "us"). By using the Service you agree to these Terms.
You must be at least 13 years old to use the Service. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
Cognivate helps you study by analyzing materials you upload and generating outlines, vocabulary, formulas, quizzes, practice problems, and tutor conversations. Generated content is intended as a study aid, not as a replacement for instruction or professional advice.

You retain all rights to the materials you upload. You grant us a limited license to store, process, and transmit your content solely to operate the Service for you, including sending it to our AI processing providers (see Privacy Policy). We do not claim ownership of your uploaded materials or of the content generated from them for your account.
Generated content is produced by large language models and may contain errors, omissions, or inaccuracies. You are responsible for verifying any information you rely on for academic, professional, or safety-related purposes.
Cognivate offers free and paid tiers. Paid tiers ("Premium") are sold as auto-renewing subscriptions through Apple's App Store.
The Service, including its software, design, and branding, is owned by Cognivate and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
You may stop using the Service at any time and delete your account from the in-app Account screen. We may suspend or terminate your access if you violate these Terms or if continued service is not commercially reasonable.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.
To the maximum extent permitted by law, Cognivate's total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, or one hundred US dollars, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.
We may update these Terms from time to time. Material changes will be communicated by in-app notice or email. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not subject to mandatory arbitration under applicable consumer-protection law.
